Dear Folks,

one of employee give resignation but not serving his notice period and he will not resume duty for completed his notice period , what we do in this case and in future he will asking about his full and final settlement so what we take action against him.

Dear Daksh Shah,

Abandonment of employment, whether during the notice period or otherwise, is misconduct and it has to be handled accordingly.

You may send the notice to the employee to his last known address by speed post for his unauthorised absence. If he does not turn up for the duties, then send him one more notice to resume the duties. If he still does not turn up, then order the domestic enquiry and send him the notice to depose before the enquiry officer. If the employee does not depose before the enquiry, then order the enquiry once more. If the employee remains intractable even then also, then the management of your company reserves the right to take disciplinary action, which of course is the termination of the services.

Keep him on the rolls of your company till you complete the above procedure. As far as FnF is concerned, tell him that he should depose before the enquiry officer. Unless the enquiry is complete, his FnF cannot be done.
