Dear Sir,
Greetings!
I want to know about if any employee work in Corporate house and he/she getting salary about INR 25000 per month and their basic salary part 16000. Are such employees will have to serve Notice Period or they can relieve immediately. Please advice and share any legal documentary proof.

Dear friend,
Notice of unilateral termination of employment by either the employer or the employee has no relevance with the salary. In case of employees covered by the ID Act,1947, unilateral termination of the employee by the employer by way of discharge or retrenchment has to preceded by one month's notice or notice pay in lieu thereof. In any other case it is to be as provided for in the contract of employment.

Thanks for reply. My question is, if employee resign from employer with satisfactory services. Thereafter employer can bound to serve notice period to employee even basic salary is less than 21000 of employee.
" One of my friend told me that has such law provision- employer can not bound to serve notice period to employee after resignation."
Please advise and if any legal proof. Regards.
