Kindly clarify my doubt on Gratuity payment calculation, when an employee availed maternity leave and left the organisation after 5 yrs, and the period of maternity leave is within the period of 5 years, whether we have to consider those leaves for calculation of gratuity or not. I think it is to be considered due to a privilege as the same is provided by the Act for the female employees? Please give your comments!
