I am a contractual teacher working under Sarva Sikhsha Abhiyan project Diretoriate. To implement RTE in our state (Assam). As per RTE section 25 govt. of Assam recruited Additional teachers engaged them in contractual service since 2012 for 5 years contract period. Now Assam govt. Extending their service term as a contractual teacher by 11 month. Where as per section 38 conferred to power function of the state legislature in the year 2011 a notification published in order to implement RTE Act, 2009 by the governor of Assam.
In that notification salary service condition of additional teachers given where govt. Shall create a permanent and professional cadre of teachers but our state engaged us under state implementation society under Sarva Sikhsha Abhiyan State implementation Society on contractual basis where agreement done with School managing committee. On the other hand we have requisite minimum qualification as per NCTE norms. Now my question is am I eligible to get gratuity and also can we claim for regularisation ? I am waiting for your response.
