My self Hiren from XXX Life sciences Pvt. Ltd., Surat. i was in Night Duty in charge and as per our company cardinal rule - chewing of Tobacco is prohibited in company premises, When i was in NDI i found one employee with tobacco so our boss told me to take disciplinary action against employee.
Here i request to kindly send me format for suspension letter for the same.

Before Suspending the Delinquent Employee, chewing Tobacco while on -duty, please First Issue a Charge-Sheet to him/her which should mentioning the Date, the Time and the Place where s/he was found indulging in the allged Act of Misconduct as per the Certified Standing Orders applicable to your Establishment. The Act of said Misconduct, if serious within the meaning of your CSO
and if the Employer/Punishing Autghority has so decided to do, may be Suspended-Pending Inquiry and a Letter to that effect may be issued immediately after the issue of Charge-sheet giving reference to the gravity of the Allegation.
Prima facie, for such act of Misconduct, Employers hardly put the Delinquent Employee on Suspension-Pending Inquiry during which Period Subsistence Allowance is payable.
Follow the Procedures laid down for such Internal/Domestic Inquiry, appoint Inquiry Officer or Inquiry Committee, Nominate Management Representative to present Managemenrt's Case and
the Principle of Natural; Justice MUST be adhered to while conducting Inquiry into the Charge-sheet and the Written Reply/Explanantion submitted by the carge-sheeted Employee in her/his defence.
