Dear All,
Actually this is old case and i solved at my own but i want suggestions as there were no reply for this post:
There is one case of Maternity benefit. One women employee is on maternity leave since 1st March & her date of delivery is 29th March. And as per the latest amendment in the act she is liable for 26 weeks leave. But she has resigned from her job on 1st April due to her personal issue. As per our policy we have 2 months notice period. In this case can we do her full and final settlement on 31st May,17. And if yes then what about her remaining maternity leave.
Please Suggest..........

Please Pay Woman Employee, maternity benefit due to her under the Act.Further, Amount towards Shortfall in notice Period as per Appointment letter can be recovered from the Woman Employee.
