Benifits under Maternity Act has to be provided to female employees as per Maternity Benefit Act, if ESIC is not applicable to the organization or female employee drawing wages more then the ceiling limit of ESIC.

Maternity benefits act applies to all organisations in the country where 10 or more employees are employed. The act applies irrespective of whether the unit is covered under ESIC
If ESIC is applicable maternity benefit will come from ESIC for all employee who are covered. For all other women employers the employer is liable to pay maternity benefit
