Hi All,
In relation to newly notified Act - Sexual Harassment of Women at Workplace..............Act, 2013 with Rules, I have few queries in relation to Annual Report mentioned thereunder -
1. Will Report be addressed to Board of Directors in case of Company or the Principal Employer marked under S&E for the related premises?
2. Do we just put Nos/ comments against each point mentioned therein or anyone have a better draft for the purpose!! Share that format.
3. Is there any due date by when this is to be submitted with Employer and Disctrict Officer?
4. Do we have clear indication with whom we need to submit this Report as Disctrict Officer (District Magistrate or Additional Magistrate or the Collector or the Deputy Collector)for establishments in Gurgaon??
5. Any other sugestion or practical problem faced by anyother member on this matter, kindly share your experience and advice.

There are two different annual reports that need to be submitted:

1. By the ICC and 2) By the Employer in its Annual report

In case of the Employer, like in case of a Registered Company which submits its annual report to the RoC, the only thing that need to be mentioned is the number of cases filed and the number of disposals in the Annual Report itself. In other cases where there is no requirement of filing Annual Reports, the same information need to be send to the District Officer.

In case of the ICC, they have to file a more detailed list of information which is mandatory:

a. Number of sexual harassment complaints received in a year

b. Number of complaints disposed of in a year

c. Number of cases pending for more than 90 days

d. Number of awareness programs or workshops against sexual harassment conducted in a year

e. Nature of action taken by the employer or district officer with respect to the cases

To answer your questions,

1. As ICC need to be formed for each branch office, the report need to be addressed to the "employer" (ie, the person who is the head of that unit, may be Branch Manager, Branch Head, or as appropriate person)

3. The report by the ICC need to be prepared for a particular calender year (ie, from 01 January 201x to 31 December 201x). However, the due dates has not been notified till now.

4. You may make a query with the District Magistrate office in Gurgaon on this regard.
