My brother B.Tech. computer fresher working as Quality Engineer from last 2 months in a Pvt. Ltd telecom company.
Two week back his name came in case of impersonation in Govt. job exam and he is on bail and FIR registered with sections 34/419/420 IPC and because of this he not gone to office for 10 days and he kept informing company he is sick.
Somehow company came to know of police case and yesterday his manager asked him to resign. What should my brother do RESIGN OR take legal path?
Any legal options in this and what will be process?

What legal path ?
your brother is involved in a case of fraud and has been named in an FIR.
That its self is grounds for the company to terminate him after conducting internal inquiry (which is independent of and not dependent on the findings of a court following the FIR).
So how do you plan to follow a legal path ?
Your brother will probably be better off resigning, at least his career records will be clean. In case of termination, the new employer will want to know why he was terminated
