Dear All seniors,

We have prepared the Charge Sheet of worker who has brought the boxes of fire crackers on 29/10/2013 during the Diwali festival for selling to the employees working in our company. The Security Staff has given report about this. The Charge Sheet was prepared on 10/12/2013 after collecting all the information about the case.

However, the General Secretary of the Employees’ Union is against issuing the charge sheet to the worker stating that they are not against issuing the charge sheet to the workers and imposing any penalty but the HR Department should have discussed the issue with the Office Bearers of the Union.

You are therefore requested to kindly advise to us whether It is necessary for the HR Department to discuss the issue with the Office Bearers of Union before issuing the charge sheet .

Whether the HR Department should discuss the issue with all the Office Bearers or only with the General Secretary of Union. Also the date of incident and date of issue of Charge Sheet is okey.

Please give an advise..

If an employee has done anything wrong or against the rules of the company, you can charge sheet the employee and for that a discussion with the Union is not at all required. It is so even if the matter is with an office bearer of the union. It is not the Union which will decide what the company or the Hr should do and if it is so what is the need of managers in the company? Therefore, you can issue charge sheet and conduct enquiry and take action against the worker. Only thing is that you have taken a long time to prepare charge sheet. Though no set of rule can be found which tells that charge sheet should be served within a certain time, it should not be delayed indefinitely.
