Dear All Seniors,
Can employer terminate the Services of the probationer by giving reason not found suitable for the position. In this case employer dispensing with Domestic Enquiry is justified & legal?
What are the formalities to be completed by the employer before terminating any probationer who is not found fit/suitable by the employer.
Thanks in anticipation.

Dear Prashant,
Probation Period literally means and itself is a period to judge the suitability of the candidate over the post appointed. If terms of engagement allow, services of a probationer can be terminated without assigning any reason and no enquiry is required. If during probation charges are leveled, then enquiry is mandatory. Pls note termination should be and conveyed before the expiry of probation period and date & time should be got noted from the employee concerned. This is so because principle of deemed-confirmation may not be claimed.
Thanks
