Hello,
As per law women will not allowed for maternity benefit if she has not completed 80 days in 12 month preceeding the expected delivery date.
I need to understand that 12 month employment is mandatory in company ?
if women joined 5 months before then will not be liable for paid maternity leave ?
what does it mean 12 month preeceding expected delivery date ?
I did not get any right answer till now.
Please help about ACT 1961 - Section 5.
In easy laguage with basic example so that anyone can understand. Thanks in advance.

If the expected date of delivery is today i.e 15 April 2013, then the female employee should have worked in that organization for minimum 80 days between 15 April 2012 to 14 April 2013.

She has joined on 26th Decmeber 2012 and she has almost completed 110 days in organization till now but she is in probation period not confirmed employee yet.
According to your answer, she should have worked 80 days between from First week of july 2012 to July 1st week 2013. Right ?
Correct me if I am not wrong and let me know whether Probation period is considered or not for paid maternity leave ?

She is entitled for getting the benefits under Maternity Benefits Act 1961.
Training period / probation period or any such term given by the employer are to be counted for the applicability of maternity benefit Act.
