Hi All concern
I am working as HR Consultant with one of the IT Company in Gurgaon.
i want to know eligibility for Maternity leaves for female employees ??
because
As the Maternity Benefit Act,1961, female employee is eligible if she has worked atleast 160 days in the following year before processing for maternity leave. but
As per the Haryana Maternity Benefit Rules , 1967, female employees is eligible if she has worked atleast 80 days days instead of 160 days.
which is binding for the employers to follow.
Kindly help me taking proper and appropriate decision for my client.

Dear Pratibha,
This is to clarify you that The Haryana Maternity Rules, 1967 do not provides us any details on eligibility. Section 5(2) of the Maternity Benefit Act, 1961 provides us eligibility condition for claiming maternity benefit & therefore go through this section for your query.
