Hi

I am working in a group of company in Kolkata. I have some confusion regarding calculation of Bonus and Ex- gratia.

As off now I have understood that an employee whose salary (BA+DA) is 10,000 or less than 10,000 is eligible for bonus. but while calculating the bonus his BA+ DA will be consider as 3500/- because as per the amended bonus act, the new limit for payment of bonus is 10,000/- and the new ceiling for calculation is 3500/-

for exp 1. : if an employee's gross salary is 15000/- where the BA (45%) + D.A (35%) is 8100/-, he will get the bonus of 3500*12*8.33% = 3499/-

for the rest part of salary that is (8100-3500)= 4600/- he will get ex - gratia , which is 1 month BA+DA.

[B]Exp . 2 , if an employee's gross salary is 18600.00/- where BA +DA is 10,044.00/- , he will get not get any bonus, but only ex- gratia , which is 1 Month BA+DA.

QU 1: Are the above two examples are correct?

QU:2 For calculation of bonus , my understanding is right?

QU:3 Is there any specific minimum or maximum limit of percentage for ex- gratia ?

QU:4: does my understanding is right as per the new amendment of bonus act?

PLEASE HELP WITH YOUR VALUABLE ADVISES.

If a employee works for 20days and getting basic salary of those working days is 2500 then how to calculate bonus for him?

Dear Sarya,
You are abosultely correct in both examples.For your clarification please note that Ex-gratia is no staturoty liability of an employer but it is merely a terms of service stipulated in contract of employment.

No he is not eligible for bonus as he has not workerd for minimum of 30 days. Mangesh Wakodkar Aurangabad

If total earning of B+DA is less than 3500.00 in any particular Month, in that case the bonus will be calculated on actual earned (B+DA). (minimum 30 days working is eligibility critaria for payment of bonus.).

the simple calculation for bonus as per statutory requirement, the basic+DA should not exceed Rs. 10000/, this is mandatory, the exgaratia is not mandatory,it is left to the management descretionay
