Many organisations are doing such mistake nowadays. Issuing Appointment letters,asking proper resignation letters, issuing relieving letters etc., are neglected in many organisations. Consequently they are facing some problems from legal side. please confirm whether the offer letter has been accepted by him. if accepted by him,discuss with him about his incapacity and ask him to give resignation letter and relieve him immediately.

No employee who is appointed in regular post can be terminate, unless the charges against him is proved during the Domestic Inquiry. B B JOSHI

Dear RK,

Although, I disapprove of taking such a measure where an employee is first offered an employment in your man power consulting firm and terminated thereafter. It is not a professional way of working. Any way, you also cannot do much in such a case where management (owner) has decided to do away with his job. There may not be ready made format available any where. I have drafted it thinking it might serve you the purpose.The text of the letter would be as under :

Dear Mr.........,

This has reference to our Offer Letter dated ............ offering you the position of ...................... in our firm w.e.f. ................ As you are aware that due to global economic downturn most of the business has severely been impacted and ours is not an exception. We have not been able to do the business as much we were expecting to do. You would appreciate that good business is necessary for growth, survival and sustenance in this highly competitive world. Just to remain competitive, we have been left with no option other than taking some stringent and harsh measures to reduce our over head cost and expenses. As such, we are also reducing our man power in order to survive and stay competitive.

As per the principle of "Last in first out", we are reducing our head count and we, therefore, regret to inform you that we shall not require your services w.e.f............. and consequently you shall be relieved after business hour on .........

However, this action may have consequence and aggrieved person may take support of a lawyer and drag you into the court. Best way is to ask the gentleman to submit his resignation letter if you want to have a piece of your mind for ever.
