1. What are the legal actions against an employer if they are harassing an employee during the notice period and they (employees) are forced to increase the stay during notice period?.
2. What actions can be taken if full and final is also not done after a month?.
3. If the employers are threatening on the relieving letters what kind of legal things can be done?.

Answer to your question 1) Read the offer letter and contract of employment carefully whether there is any breach in the notice period by employee. If so, either the employee has to serve notice period as per terms in offer letter / contract of employment or come to terms with employer by adjusting the balancing of notice period by way of adjusting his leaves accrued. Convince the employer quoting the terms of offer letter / contract of employment. Keep cool and don't get into an argument with employer as it will further complicate the issue. Buy some time and think over what can be done & take help from professionals in the respective field.

Answer to your question 2) Two options 1) Talk to the management for sorting out the issue and give them all the genuine reasons why full and final settlement is necessary to be done. 2) Assure your best support in sorting out the issue.

Answer to your question 3) Any issue should never go to the point of threatening. Ultimate loser is employee. Employer can manage anything with all the resources at his disposal. Resorting to legal battle should be a last resort.

Dear All three are not proper which the Employee can protest.When a person is on Notice period the best the Management can do is to insist the employee to complete unfinished tasks /assignments for which his original job responsibility will demand. rajanassociates https://www.citehr.com/285737-legal-...-industry.html
