Gratuity is not a deposited amount anywhere from where an employee can withdraw it.It is to be paid to the employee concerned by the employer if he is eligible to get it.

Then file a claim case before the Controlling Authority under The Payment of Gratuity Act, 1972 of the the area concerned & prove that the gratuity payment has been withhold or deducted illegally by the bank management.

After completion of 5 years continuous service in the same organization employee wil eligible gartuity & IN CASE Resigned/Expired/Superanuation fund/diablement wil payable to gratuity to the employee

I had resigned my job 07.06.2010. (DOJ:01.04.1998).when will i have receive my gratuity amount in my old office.Bz still date i have not recd gratutity amount.Kindly give deatils of rules.
