1) Pls explain difference b/w wages and salary.
2) If salary of a employee is not paid from two months what penalties can be faced by employer
3) if any establishment is based at x city (say for ex if HO/Corporate office is in Bangalore) and having offices in a,b,c cities i.e offices in ( Delhi,Bombay,Chennai) can an employee working in Delhi office can file a case against his employer in Delhi labor court against non payment of salary for more then one month

there is no difference between wages and salary.we have only created these two words.if an employee does not get wages/salary for two months than case can be filed with labour commissioner under payment of wages act section 15(3).there is a provision for ten times penality.in your xcase you can file case in delhi itself.

Dear Ruchi,
1. We have given this terminology of wage for workers/employee while salary word is used for staff.
2. If salary for two months is not paid by the employer to any worker/ employee & he is entitled to get relief under the Payment of Wages Act,1936 then he can made a complaint to the area labour Inspector & if his complaint not settled then he can file his claim case before the Auhtority under the Payment of Wages Act of the area. He can also straight way file this claim case. Ten time penalty can be awarded if the case is proved for illegal deductions but if the case is for non /delayed payment of wages then this ten time compensation is not to be awarded. In cases of delayed wages this compensation is upto Rs.3000/- but not less than Rs.1500/-.
3. Claim case is to be flied before the Authority of the area in whose jirisdiction the employee has worked.

practically if will ask me there is no difference.these are the names which we have have given from time to time .if you go to seventies thre was no personnel manager
or HR manager.company used to call this guy as labour officer.than trend change and
name changed to personnel manager .after that almost all company gives the name of
HR manager to this guy.this is position practically in india.
ofcourse theritically difference is thereand HR managers should totally take the responisblity of empoyees development activities whereas personnel manager should take care of routine work .

Dear Ruchi,
Normally Wages denotes remuneration paid to workers/ Labour. Salary is remuneration paid to staff.
Employee can file application for unpaid wages/salary to the concerned Labour Office under Payment of Wages Act as monthy paid employee should get his/her remuneration with 7 days of last working day of previous month. But Labour Dept can entertain this application if employee is covered under wages limit priscribed under Act.

U/S 15 penalty to which such employer is liable to refund to the employed person of the amount deducted or the payment of the delayed wages together with the payment of such compensation as the authority may think fit not exceeding ten times the amount deducted
